CONDITIONS OF SALE

All orders are accepted subject to these terms and conditions and to the exclusion of any conditions proposed by the customer.

1 - You undertake that all details provided to East Midland Welding Supply Co. are correct and the credit or debit card you are using is your own. You give authorisation that your personal information be used for the purpose of processing your order and delivery of goods.

2 - All prices shown are inclusive of VAT at the current 20% rate and subject to change in line with VAT rates. Prices charged will be the price shown on the date of order as displayed on our website. If a pricing error is discovered, we will inform you as soon as possible. We shall be under no obligation to fulfil an order for a product advertised at an incorrect price, if the item(s) has been charged and not despatched we will cancel and refund your order.

3a - A carriage charge of £9.50 Inc. VAT is applied to all orders to be delivered in the mainland UK. Other delivery areas are available on application. East Midland Welding Supply Co. uses a contract carrier to deliver all goods of a reasonable size, weight and value on a standard 1-2 day service to the mainland UK. Ex Stock orders placed before 3:30pm Mon-Fri are despatched the same day. Goods shall be at the risk of the customer from the time of delivery.

3b - If delivery of goods be delayed or prevented for any cause whatever beyond the company's reasonable control then at the company's option the unperformed part of the contract may be cancelled or time for delivery shall be extended. Such cancellation shall be without prejudice to already accrued rights of either party.

3c - The customer shall unless otherwise specifically agreed be responsible for providing adequate labour and facilities at the delivery points for unloading goods ordered by him, and shall keep the company indemnified against all claims whatever arising from such unloading operations.

3d - You must ensure that all deliveries are properly examined prior to acceptance. If your delivery is damaged or incorrect please indicate on the courier delivery note and advise our customer services team within 24 hours of receipt by phone or email.

4a - Full protection under warranty is provided according to UK law. A 12 month return to base warranty is provided on all products except torches (which are subject to a manufacturer's 3 month guarantee) and consumables unless specifically stated by us as exceeding this level on a per product basis. Any warranty work must first be authorised by East Midland Welding Supply Co. For goods supplied the manufacturer's conditions shall apply unless otherwise agreed in writing.

4b - Cancellation of orders already accepted by the company will be accepted only at the company's discretion and the company may charge for all work carried out or expenses incurred by it prior to the date of dispatch. All dates or periods are quoted in good faith but no liability is accepted for delivery and consequential delays however caused.

4c - Please obtain a returns note number prior to returning any goods to East Midland Welding Supply Co. and note this number clearly on any returned packages. Returns note numbers are valid for a period of no more than 30 days and authorisation may be removed after that time.

4d - All claims for transit damage or loss must be submitted in writing to the company within 24 hours of delivery. In the case of non-delivery of the whole consignment claims must be submitted in writing to the company within 24 hours of receipt by the customer (or customer's agent) of notification of dispatch of the goods. In the absence of claims within these time limits the goods shall be deemed to have been properly delivered.

4e - The company will replace or at its option repair free of charge or refund the price of any goods in which defects solely attributable to faulty materials appear within the manufacturer's warranty period and validity of the claims is confirmed by the manufacturer provided the customer notifies the company immediately any such defects are detected and (if so requested) return the goods at his own cost. No liability is accepted for customer's remedial expenses, damage to property, loss of profits, or consequential damage, loss or injury however caused. All other conditions and warranties relating to the characteristics of the goods their quality or fitness whether express or implied by statue or otherwise, expressly excluded.

5 - The company shall be under no liability to for any failure on the part of the customer to comply in all respects to relevant safety precautions and transportation, handling, storing or fixing instructions set out or referred to in the manufacturer's latest trade literature, or incorrect use of goods, and the customer shall indemnify the company against any cost, claims or demands which may be incurred by the company as a result of any such failure on the part of the customer.

6 - All weights and measures quoted are approximate and for conversion purposes only. Prices are as per the quantities specified in the product descriptions.

7 - All contracts with the company shall be deemed to have been made in England and shall in all respects be construed and operate in accordance with English law.

8 - Product Descriptions and images are given in good faith but may change without notice and do not form any part of any sales contract.

9 - All 3rd party trademarks are acknowledged throughout.

10 - Errors and omissions excluded.
